These Terms govern your use of all aspects of our business, including our consultations, services, products, subscriptions, and communications. Please read these Terms carefully, as they set out your rights and obligations. If you do not agree to these Terms, you may not use our website or services.

1. Acceptance of Terms

By accessing our website or services, you acknowledge that you:

- Are at least 18 years of age or are legally authorised to engage in a contract on behalf of a minor.

2. Services Provided

NutriGeneXperts offers telehealth consultations, DNA analysis, wellness plans, and recommendations for supplements as part of our complementary health services. These services are not intended to replace professional medical advice, diagnosis, or treatment provided by licensed medical professionals. You acknowledge that the services provided by NutriGeneXperts are complementary health services and that it is your responsibility to consult a licensed healthcare professional for medical concerns.

Treatment and Referrals

All treatments, recommendations, and health plans provided through NutriGeneXperts telehealth services are based on a review of the client’s health history, DNA test results, nutritional assessments, lifestyle evaluations, and other relevant health information gathered during consultations. NutriGeneXperts takes an integrative approach to wellness, incorporating health modalities such as nutrigenomics, herbalism, and nutrition.

If additional testing is required, NutriGeneXperts will organise this as part of the service. Should a client’s condition require in-person examination, diagnostic testing, or specialised medical care beyond the scope of our services, we will refer the client to an appropriate healthcare provider. Our services do not replace medical care that requires direct clinical assessment, and we encourage clients to consult with licensed healthcare professionals as needed.

3. Informed Consent

By engaging in consultations and purchasing services from NutriGeneXperts, you consent to:

- Receiving health advice and treatments based on our professional judgment.
- Understanding that our services are complementary to medical advice and not a substitute for medical care.
- Accepting that individual outcomes may vary and that NutriGeneXperts cannot guarantee specific results.
- Acknowledging that all recommendations, including supplements and further consultations, are designed to work alongside your current healthcare regimen and do not replace the advice of licensed healthcare providers.

4. Health and Medical Disclaimer

NutriGeneXperts does not provide medical advice. The information and services offered through our website and consultations are for general wellness purposes and are not intended to diagnose, treat, cure, or prevent any disease. Always seek the advice of your physician or other qualified health provider with any questions regarding a medical condition. In case of an emergency, contact your healthcare provider immediately.

5. Privacy and Data Protection

6. Intellectual Property

7. Subscriptions and Services

NutriGeneXperts offers a range of ongoing subscription services, including wellness plans, telehealth consultations, plan updates, and access to additional resources. Subscriptions are designed to automatically renew based on your selected plan, ensuring uninterrupted support unless you choose to cancel. You are responsible for all payments and fees associated with your subscription, which will be billed according to the plan you have selected. NutriGeneXperts reserves the right to modify the pricing, features, and terms of any subscription service, including upgrade options and family plans, with notice provided to you in advance of any changes.

Upgrade Options for Plans:

NutriGeneXperts offers a variety of upgrade options for your wellness plans to provide enhanced services and continued support. These upgrades are available on request and include:

- Additional Consultations: You can increase the frequency of telehealth consultations to suit your evolving health needs, providing more regular check-ins and updates.
- Expanded Wellness Plans: Upgrade to a more comprehensive wellness plan that covers additional health areas, providing a deeper level of analysis and personalised recommendations.
- Supplement Optimisation: Access enhanced supplement protocols designed to address new findings from your genetic analysis or evolving health needs.

All upgrade options are subject to additional fees, which will be clearly communicated to you at the time of request. Upgrades will be added to your current subscription and automatically billed in the following cycle unless cancelled or modified.

Extended Family Plan Terms & Conditions:

The Extended Family Plan allows you to add immediate family members to your subscription for an additional fee of $40 per person per month. Family members added to the plan will receive the same personalised care and support services as the primary subscriber. The following terms apply:

- Eligibility: Only immediate family members (spouse, children, parents) are eligible for the Extended Family Plan.
- Coverage: Each family member added to the plan will receive access to wellness plans, telehealth consultations, and updates, mirroring the primary subscriber’s subscription services.
- Payments: The family member fee of $40 per person per month will be charged in addition to the primary subscription fee. This fee will renew automatically with your primary subscription unless cancelled.
- Cancellation: You may cancel individual family member coverage or the entire Extended Family Plan at any time. However, cancellation must be done before the next billing cycle to avoid being charged for the following month.
- Changes to Pricing: NutriGeneXperts reserves the right to modify the pricing of the Extended Family Plan, with notice provided in advance of any changes.

8. Products and Services: Refund and Return Policy

Services:

Fees for consultations and health services are non-refundable once the service has been provided. This includes, but is not limited to, telehealth consultations, personalised wellness plans, DNA analysis reviews, and any additional follow-up services. If a service is booked and you are unable to attend, you must notify us at least 24 hours in advance to reschedule. Failure to provide sufficient notice may result in the forfeiture of fees.

In the event of technical issues or an error on our part, we will work with you to reschedule the service or provide an appropriate solution. NutriGeneXperts reserves the right to modify service fees with prior notice.

Products:

- If you receive an incorrect or damaged product, you may request a replacement within 14 days of delivery.
- We do not accept returns on opened products or digital content (e.g., downloadable health plans or protocols).
- Refunds for unfulfilled orders or errors will be processed minus any applicable bank or processing fees.

9. Limitation of Liability

NutriGeneXperts provides complementary health services and recommendations based on the information you provide. While we strive to offer the best guidance, we cannot guarantee specific outcomes or results. You acknowledge that individual reactions to treatments, supplements, and protocols may vary, and you agree that NutriGeneXperts is not liable for any adverse outcomes, except where required by Australian Consumer Law, or where we have failed to exercise reasonable care or skill in providing services.

10. User Obligations

By using our services, you agree to:

- Provide accurate and complete health information during consultations.
- Not engage in any unlawful or prohibited activities through the website or services.
- Comply with all applicable laws and regulations regarding the use of our services and products.

11. Prohibited Uses

You may not use our services or website for any unlawful purpose, including but not limited to:

- Violating any intellectual property rights of NutriGeneXperts or others.
- Transmitting harmful code, viruses, or any content that may harm the functionality of the website or services.
- Harassing, threatening, or abusing any of our staff or other users.

12. Code of Conduct

We maintain a zero-tolerance policy for any form of violence, abuse, or intimidation towards our staff. Any incidents of aggression, threats, or physical assault will result in immediate termination of services and may lead to legal action.

Compliance with the HCCC Schedule 3 Code of Conduct:

As a non-registered practitioner, NutriGeneXperts and its practitioners are required to comply with the Health Care Complaints Commission (HCCC) Schedule 3 Code of Conduct. This Code governs our professional conduct, ensuring we uphold the highest ethical standards in delivering complementary health services. If you believe our conduct is in breach of the HCCC Code, you may lodge a complaint directly with the Health Care Complaints Commission in New South Wales.

13. Termination of Services

NutriGeneXperts reserves the right to terminate your access to our website and services if you violate these Terms or engage in any behavior deemed inappropriate or harmful to our business or staff. Upon termination, any remaining fees owed for services rendered will remain your responsibility.

14. Governing Law

These Terms will be governed by and construed in accordance with the laws of Australia, and any disputes will be resolved under the exclusive jurisdiction of Australian courts.

15. Dispute Resolution

In the event of any dispute between you and NutriGeneXperts arising out of these Terms or your use of our services, the parties will first attempt to resolve the matter through informal negotiation. If a resolution cannot be reached, the dispute will be resolved through binding arbitration in accordance with Australian law.

16. Amendments to Terms

NutriGeneXperts reserves the right to modify these Terms at any time. Any changes will be posted on this page, and continued use of our website or services constitutes your acceptance of any modifications.
